From the survey: “The tract is being accessed by a 9 feet wide gravel drive across the West adjoining tract. There is also an electrical line at the North side of the drive servicing the tract. This is the 25 feet wide easement. The cemetery is shown at the physical location. There would also be public access for the cemetery. The home encroaches South 11 feet. There is also a well and fence South of the house.” The survey is attached as a supplemental document. The seller has received letters/notices of a hearing regarding an unsafe property from the Delaware County Building Commissioner. The hearing is scheduled for March 18, 2024. Copies of the letters are attached as supplements to the listing on the BLC for review. In addition to the demolition of the structures on the property there are issues with the well and septic systems and an empty pool that must be filled in. The well on the neighboring property will need to be removed per the request of the neighbor to the South of the parcel as it is located on her property. A buyer intending to improve the property must obtain a PERC test and soil test to make sure that a new well and septic may be installed. Delaware County Planning has issued demolition orders for the buildings and the well must be closed/vacated due to encroachment.
